NPC Standing Committee adopts the Decision on the Prohibition of Narcotic Drugs, naming cannabis in PRC statute for the first time
The Standing Committee of the 7th National People's Congress adopted the Decision on the Prohibition of Narcotic Drugs, promulgated the same day under Presidential Order No. 38. Article 1 defines narcotics as opium, heroin, morphine, cannabis, cocaine and other addictive substances designated by the State Council, which is the first time cannabis is named in national PRC legislation. Article 6 provides that illegal cultivation of poppy, cannabis and other narcotic source plants is subject to mandatory eradication in all cases, and exempts from penalty growers who destroy a crop themselves before harvest. Explicit plant-count thresholds are given only for opium poppy at 500 and 3,000 plants, leaving cannabis inside an undefined category of other narcotic source plants. Article 10 permits the national health administration to designate specific sites to cultivate narcotic source plants for medical, teaching or research purposes.
