South Africa publishes draft cannabis limits of 750 g possession and five plants for private use

The Department of Justice and Constitutional Development published draft regulations under the Cannabis for Private Purposes Act 2024 in Government Gazette No. 54061 on 2 February 2026, as Regulation Gazette No. R. 7067. The draft provides that an adult may not possess more than 750 g of cannabis for private purposes at any given time during the course of a single day, whether in a private or a public place. It further provides that an adult may not cultivate more than five cannabis plants in a private place at any given time regardless of size, shape or strain, and that no more than 750 g may be transported cumulatively. In a statement of 3 February the Ministry invited written comment by 5 March 2026, said the limits would go to Parliament for approval before coming into effect and said the Minister had considered what may reasonably constitute private use, the number of plants needed to support it and international benchmarks. The Ministry also stated that the Act does not reach commercial cultivation or the buying and selling of cannabis, nor the recognition of traditional growers, and that those matters are being handled by other departments.
