Page scope
Law 1787 of 2016 covers Colombia's Law 1787 of 2016 as amended, for what it does to cannabis: the definitions, state control and licensing of growing, seed and derivatives, the provisions on small growers and rural communities, and the exceptions it added to the Penal Code. The decrees that regulate it (613 of 2017, 811 of 2021 and 1138 of 2025) are treated in the Implementation section, not on pages of their own. The industrial hemp statute, Law 2204 of 2022, is a separate law. The wider history of medical-cannabis licensing and of adult-use proposals is on Cannabis law in Colombia.

Sources

  • The law. The provisions are cited from the consolidated text in the legislative database of the Secretaría General del Senado (Avance Jurídico compilation; the copy read on 2 November 2026 was last updated on 15 October 2026). It prints the sanction, "Dada en Bogotá, D. C., a 6 de julio de 2016", signed by Juan Manuel Santos, and the heading "Diario Oficial No. 49.926 de 6 de julio de 2016".
  • Amendments. The rewriting of articles 6 and 8 by Decree-Law 2106 of 2019 and the corrections by Decrees 1830 of 2016 and 635 of 2023 are given as the consolidated text records them.
  • Decree 613 of 2017. Read in the signed copy published in the library of Invima (35 pages).
  • Secondary. Cruz Olivera and Pereira Arana, Laberintos de prohibición y regulación (2021), chapter 5, pp. 128–135, are attributed on the article. Their figures on the quota requested from the International Narcotics Control Board cite Jelsma and others (2019). Decree 579 of 2017 on small and medium growers is known here only from their account.

Where the sources disagree

  • The law amended by article 13. Article 13 describes article 376 of the Penal Code as "modificado por el artículo 11 de la Ley 1153 de 2011"; the compilation marks the reference "<sic, es 2007>". Article 376 was rewritten by article 11 of Law 1453 of 2011. The article names article 376 without repeating the reference.

Open points

  • Small growers. Paragraph 6 of article 3 gave the government six months to regulate the protection of small and medium growers. The definition of small and medium growers in Decree 579 of 2017 is given as Cruz Olivera and Pereira Arana report it; whether other regulations followed under the paragraph is not established.
  • Decree 1138 of 2025. The decree gave the ministries five months to issue the technical rules for the cannabis flower as a medical product. Whether they have been issued is not established.
